Estate planning can be overwhelming. We’re here to lead with education and clarity to make the process as easy as possible.

The cost of probate in Arkansas depends on the value and complexity of the estate. Expenses can include attorney fees, personal representative fees, court and filing costs, appraisals, and other administrative expenses. Use the Arkansas Probate Calculator above to estimate potential probate costs based on the value of an estate.

Arkansas law provides a statutory fee schedule for ordinary legal services performed during probate. Under Arkansas Code § 28-48-108, the fee is calculated using percentages that decrease as the value of the estate increases. Actual attorney fees can vary depending on the circumstances and complexity of the estate.

Probate in Arkansas can take several months to more than a year depending on the estate. The timeline can be affected by creditor claims, property that needs to be sold, disputes among beneficiaries, and other complications. A straightforward probate may move faster, while a complex or contested estate can take considerably longer.

Generally, assets owned solely by someone at the time of their death and without a beneficiary designation or other method of transferring ownership may need to go through probate. Assets held in a properly funded trust, jointly owned property with survivorship rights, and accounts with valid beneficiary designations may pass outside of probate.

Arkansas has a simplified process for certain estates valued at $100,000 or less, after accounting for encumbrances and excluding certain property allowed by law. Other requirements must also be met, including waiting at least 45 days after the person’s death before using the small estate procedure.

No. A will tells the court how you want probate assets handled, but having a will does not automatically keep an estate out of probate. Other estate planning strategies, such as a properly created and funded living trust and appropriate beneficiary designations, may help certain assets transfer without probate.

Yes. Assets properly transferred into a revocable living trust generally can be distributed according to the trust without going through the traditional probate process. Simply creating a trust is not enough, however. The appropriate assets must also be properly titled or transferred into the trust.

There isn’t one strategy that works for every family. Depending on your assets and goals, an estate plan may use a living trust, beneficiary designations, joint ownership, or other planning tools to reduce the assets that would otherwise pass through probate. An Arkansas estate planning attorney can help determine which approach makes sense for your family.
